Delta 9 THC was federally legalized with the passing of the 2018 Farm Bill. As per the guidelines outlined in the bill, for a product to be deemed federally legal, it must contain no more than 0.3% THC and be derived from hemp. The Delta 9 molecule itself isn’t banned. Only products that exceed that limit fall under the Controlled Substances Act.

State law is a different story. The 2018 Farm Bill set a federal floor, not a ceiling. Some states have gone further, passing laws that restrict or outright ban hemp-derived THC products regardless of the federal threshold.

This standard is changing, and soon. A federal law passed in November 2025 redefines hemp starting November 12, 2026, replacing the old delta-9-only threshold with a total THC standard, and adding a strict cap of 0.4 milligrams of total THC per container on any finished product. 

As of now, the rule is being challenged. Multiple bills would delay it to 2028, repeal it outright, or replace it with a different regulatory framework, but as of today, none of them have passed, and the November deadline stands unless that changes.

State law adds a separate layer on top of whatever the federal standard is, before this change and after it. Even a fully federally compliant product can still be restricted or banned by an individual state. Some states are also moving to align their own laws with the incoming federal shift.

Methods of Delta 9 Administration: A Spectrum of Experiences

Smoking and Vaping (Onset: Immediate to a few minutes | Duration: 2-4 hours)

These methods typically offer the fastest onset. When D9 vapes are inhaled, Delta-9 enters the bloodstream through the lungs’ alveoli. It also reaches the brain before the liver gets a chance to convert it, so unlike edibles, you’re feeling Delta 9 itself first, not the 11-hydroxy-THC metabolite edibles produce.

This direct route lets users feel effects almost instantaneously, often within a few minutes.

Edibles (Onset: 30 to 90 minutes | Duration: 4-8 hours)

Oral consumables like Delta 9 THC gummies and Delta 9 edibles take a long time to take effect because they have to go through an extensive digestion process. One extra step needed to complete the digestive process is transforming the Delta 9 THC compound in the liver before entering the bloodstream.
