Step 1: It Starts With the Plant

The Delta 9 extract in every The Hemp Doctor drink begins as quality hemp flower grown on farms in Colorado and North Carolina. Our sourcing partners follow organic farming practices, and every incoming batch is tested before it enters production. Quality starts at the farm, not the bottling line.

Step 2: From Flower to Extract

Once the hemp is harvested, it’s dried, milled, and prepared for extraction at our production facility. We use supercritical CO₂ extraction to pull the plant’s cannabinoids and terpenes without relying on harsh chemical solvents. The result is a clean, concentrated hemp extract that gives our formulation team the cannabinoid profile they need to build each drink. It’s a more precise approach to extraction, and it gives us greater control over what goes into every can.

How Are THC Drinks Legal for Now? (What Comes Next)

THC drinks from The Hemp Doctor are federally legal under the 2018 Farm Bill, which permits hemp-derived products containing no more than 0.3 percent Delta-9 THC by dry weight — for now. What Changed in November 2025

Section 781 of the Continuing Appropriations Act 2026 was signed into law on November 12, 2025, with a one-year window before it takes effect.

The change that matters most for the beverage category is a 0.4 milligram per container cap on finished consumable hemp products. That cap is not a concentration percentage. It is an absolute limit on the total milligrams of THC allowed in a single container, regardless of size. Every Delta 9 drink currently on the market exceeds that threshold. If the cap takes effect as written, it would require complete reformulation across the entire hemp beverage category.

The Delay and Where Things Stand

H.R. 6500, signed September 2, 2026, extended the Section 781 provisions affecting naturally occurring cannabinoids — including hemp-derived Delta-9 — to December 11, 2026. That extension buys additional time for both the industry and regulators to develop implementation guidance. Congressional efforts to modify or replace the 0.4 milligram per container cap are ongoing, and the legislative picture continues to shift.
