Delta 8, Delta 9, THCA, and CBD are four of the most talked-about compounds in hemp, though they’re not all the same kind of thing. Delta 8 and Delta 9 are both forms of THC. THCA is the acidic precursor that becomes THC once heated. CBD isn’t part of that family at all, a completely different cannabinoid that never produces a high. Is Delta 8 THC Legal?

The 2018 Farm Bill automatically removes Delta 8 from the federal list of controlled substances as long as it’s hemp-derived and contains less than 0.3% Delta 9 THC. Under that standard, companies have been free to manufacture, distribute, and sell Delta 8 products across the US.

That standard is changing. A federal law passed in November 2025 redefines hemp starting November 12, 2026, replacing the delta-9-only threshold with a total THC standard and adding a cap of 0.4 milligrams of total THC per container on any finished product. Delta 8 runs straight into that cap: a typical pack of Delta 8 gummies or a standard tincture carries far more total THC than 0.4mg. 

There’s also a second Delta-8-specific question in play: the new law excludes cannabinoids chemically converted outside the plant, and most commercial Delta-8 is made exactly that way, through isomerization from CBD. Whether that provision technically applies to Delta 8, which also occurs naturally in trace amounts, is still genuinely disputed among legal analysts. Either way, the per-container cap alone is enough to exclude nearly all Delta 8 products as currently formulated, regardless of how that second question resolves.

The rule is being challenged. Multiple bills would delay it, repeal it outright, or replace it with a different regulatory framework, but as of today, none of them have passed, and the November deadline stands unless that changes.

As of now, most states currently allow Delta 8 in some form, though a meaningful number attach real restrictions, sometimes to specific formats rather than the compound as a whole, and a minority prohibit it outright. That mix shifts often enough that any specific count we printed here would likely be wrong within months.
