These Peach Gummies Contain THC – Is That Legal?

The simple answer is, “Yes,” they are federally legal throughout the United States, and let us explain why.

In 2018, the President signed the Farm Bill, which made it legal to manufacture and sell hemp-based products. Now, a lot of people get confused when talking about hemp because they falsely believe that hemp is the same thing as marijuana. It is not. While they are of the same cannabis family, there are large differences between the two. While both plants carry many beneficial cannabinoids like CBD, CBD, and CBG, the most prominent difference between these plants is that marijuana contains much higher concentrations of the cannabinoid THC than hemp does. We are all familiar with tetrahydrocannabinol (THC) and its ability to produce a psychoactive “high” when someone smokes or otherwise ingests marijuana. This is the reason that marijuana is not currently legal on a federal level, although it is now legal for recreational use in some states.

The Farm Bill is very specific about only legalizing hemp-based products on a federal level because hemp contains much lower levels of THC. In fact, The Farm Bill goes on to specify that the hemp-derived product may contain no more than .3% THC to still be legal. This is because this trace amount of THC will not produce the same psychoactive side effect that you find with marijuana.

It may surprise you to learn that this is not the first time that hemp and hemp-based products have been legal in the United States. Hemp was first introduced to North America back in 1606. Immediately, farmers began cultivating the crop to produce products like lamp fuel, rope, and paper. In fact, hemp became such a staple in the U.S. that farmers in the 1700s were legally required to grow hemp! In World War II, the USDA began the “Hemp for Victory” program, which led to the production of 150,000 acres of hemp to be made into various products to help the war effort. It wasn’t until 1970 that hemp was classified along with marijuana as an illegal Schedule 1 drug – which many disagreed with – and strict regulations began that all but killed the production of hemp in the U.S. Now, with the passage of the amendment to the Agricultural Improvement of 2018 (a.k.a. the “Farm Bill”), hemp is again legal.

So rest assured that all of The Hemp Doctor’s full spectrum CBD products that contain THC are fully compliant with The Farm Bill and therefore federally legal to sell and consume throughout the United States.

Full-Spectrum vs. Broad-Spectrum Edibles – Which Is Better?

At The Hemp Doctor, we offer our customers a wide array of options when they are shopping for tasty CBD edibles. We like having choices, and we know you do, too! That’s why we offer numerous flavors and textures as well as full-spectrum and broad-spectrum options.

Many customers wonder whether it is better to consume a full-spectrum or broad-spectrum. Frankly, they are both great! It is simply a matter of preference. Here’s the difference:

A full-spectrum hemp-infused edible features a powerful blend of our phytocannabinoid-rich hemp extract. The potent ingredient features several beneficial compounds, including CBD, CBG, CBC, and many more. Full-spectrum products also contain up to .3% THC, which complies with the law. When combined, these compounds help maximize your wellness experience by allowing you to enjoy The Entourage Effect – the result of consuming many beneficial ingredients simultaneously.

A broad-spectrum hemp-infused edible features almost the same powerful blend of our phytocannabinoid-rich hemp extract, with one major difference. For broad-spectrum products, we take the extra measure of removing the residual amount of THC for your peace of mind. Consumers can still reap the benefits of The Entourage Effect, as our hemp extract is rich with beneficial compounds!

The bottom line: both full-spectrum and broad-spectrum CBD edibles are excellent, and both comply with the law. It comes down to a matter of preference. Those who prefer not to consume trace amounts of THC will favor broad-spectrum products, but both will deliver The Entourage Effect!
