Are Pre Rolls Legal in the US?

Yes. Hemp-derived thc-a pre rolls like what we offer are federally legal to buy and enjoy today. The 2018 Farm Bill removed hemp from the Controlled Substances Act and defined it as cannabis containing no more than 0.3% Delta-9 THC on a dry weight basis. Because THCA does not become Delta-9 THC until you apply heat, THCA flower (what’s inside our pre rolls) fits the “hemp” definition. 

Federal law sets the floor, not the whole story. Some states do count the “total THC” (Delta-9 plus all the THCA that turns into Delta-9 once you light up), while a few ban intoxicating hemp products outright. Here in North Carolina, hemp pre rolls remain fully legal under Session Law 2022-32. Wherever you live, spend five minutes checking your state’s rules before you order. It beats a headache at the mailbox.

What Changes on November 12, 2026

A federal law signed on November 12, 2025 (Section 781 of the shutdown-ending funding bill) rewrites the definition of hemp. Two changes matter for pre rolls: hemp must now test at 0.3% or less total THC, THCA included, and finished products get capped at 0.4 milligrams of total THC per container. As written, THCA pre rolls would stop counting as legal hemp when the law takes effect on November 12, 2026.

Bills in Congress are trying to repeal Section 781 or delay it to 2028, though none has passed yet. And here at home, North Carolina’s HB 328 would match the federal caps and is one House vote away from the Governor’s desk.
