And since we’ve been talking about San Antonio’s long history, we thought it would be fun to first give you a brief history of the legal status of Delta 8 THC and hemp in general.

History of Hemp and Its Legal Status

Delta 8 THC, CBD, and other popular cannabinoids on the market today are all derived from the cannabis family of plants. These plants come in two main strains: indica and sativa. The cannabinoids from the indica plant tend to have a more relaxing quality when used, while sativa allows the user to be more alert. Now within these two strains, you also have two different varieties of the cannabis plant: hemp and marijuana.

The main distinction between these two plants is that hemp has large amounts of CBD and low amounts of THC, while marijuana has high amounts of THC and lower amounts of CBD. As you are probably aware, marijuana’s heightened level of THC is what causes the psychotropic high feeling the user experiences when smoking or ingesting it. This distinction is important as we talk about the cannabis plant’s legal standing throughout the years.

The hemp variety of the cannabis plant has been used throughout the ages for a number of purposes that include making parchment, sails, clothing, and even fuel oil. In fact, archaeologists have found hemp products dating back as far as 10,000 years ago. This plant’s remarkable fiber structure makes it ideal for constructing a number of different items. Hemp’s continued popularity carried over into the founding of the United States. During the 1800s, there were times when farmers were actually required to grow hemp.

Many may argue that the marijuana variety of the cannabis plant, on the other hand, doesn’t have as distinguished of a history. Marijuana had been used by the Mexican population for many years for medicinal and recreational purposes. After the Mexican Revolution, many Mexican immigrants flooded into America during the 1910s and 1920s and they brought their love of marijuana with them. Because of paranoia and anti-Mexican sentiment public opinion turned against marijuana and the Marijuana Tax Act of 1937 was passed. This Act basically banned marijuana by placing an unwieldy tax on it.

It wasn’t until the 1970s and the War on Drugs that marijuana was classified as a Schedule 1 drug along with other drugs such as LSD and heroin. This classification made marijuana federally illegal throughout the United States. Unfortunately, in their exuberance to take on the drug problem, the US government lumped the hemp variety of cannabis plant into the same category as the marijuana variety and made it completely illegal as well.

It wasn’t changed until 2018 that the Agricultural Improvement Act (commonly known as The Farm Bill) was signed into law. This Act made all cannabis products federally legal on the following conditions:

  • The product had to be derived from hemp, not marijuana;
  • The hemp had to be grown by a licensed hemp farmer; and
  • The final product derived from hemp could not contain more than 0.3% THC by weight.

This Act opened up a cannabis-based market that has skyrocketed the popularity of both CBD and Delta 8 THC products.

The Farm Bill of 2018 specifies that the THC referred to in its wording is the Delta 9 THC cannabinoid. Because of this specification, Delta 9’s sister cannabinoid, Delta 8 THC, is considered the same as CBD and therefore is legal on a federal level. New Challenges to Delta 8 THC Legality and Availability

Another recent challenge to Delta 8 THC products has been introduced by the Drug Enforcement Administration (DEA). The DEA added Delta 8 THC to its list of controlled substances in August of 2020. This decision has been challenged by the Hemp Industries Association, as it is an overreaching attempt to ban Delta 8 THC by rule. In addition, the DEA still would have to have The Farm Bill of 2018 amended to include Delta 8 THC. Because they have not taken this action, Delta 8 THC remains legal on a federal level.
