What Are The Laws About Hemp In New York State?

Recreational adult-use cannabis is legal for NY residents who are 21 years or older, but it does come with some restrictions. For example, you can’t have more than three ounces only for your person, selling any amount is a misdemeanor, and selling over 25 grams without a license is a felony.

Furthermore, you don’t need a hemp grower license to grow marijuana for personal use. You can grow up to six herbs, only three of which may mature simultaneously at any time. Cannabidiol products, on the other hand, are very strictly regulated.

For example, CBD edibles can’t contain more than 25mg of CBD per product, and while the substance is allowed in food and drink, its presence in products that also contain tobacco or alcohol isn’t. Dietary supplements can’t contain more than 3g (3,000 milligrams) of CBD.

However, hemp products can have more than 0.3% THC—and up to 3%—but only when handled by appropriately licensed hemp farmers and hemp processors. Furthermore, processors can’t claim that their products have any medical or therapeutic properties and have to be tested by a third-party lab for heavy metals, microbial impurities, and THC and CBD content before entering the market.
