As more and more Americans get vaccinated against the COVID-19 virus, it is once again becoming safe for you to leave your home. As a result, more and more state restrictions are being lifted to allow their residents to once again get out in the world. With this newfound freedom, the first item on many folks’ wish list is to travel again. As a result, airline seats are getting booked and the roadways are beginning to return to their prior traffic levels.

So if you are ready to travel and are an avid CBD or Delta 8 THC user, you may be concerned about certain aspects of traveling with your product. What would be the safest to bring? Will I run into any legality issues going from one state to another? With these questions in mind, here are some tips on traveling with CBD and Delta 8 THC products.

Traveling with CBD and Delta 8 THC Products

Our first suggestion for travel with your favorite CBD or Delta 8 THC product is irrelevant to the type of travel you choose. Whether it be by airplane, car, bus, or train, we suggest that you do not travel with any of our hemp flowers, prerolls, or kief. The reason for this is that these products may be mistaken for marijuana. Even if you bring them in their original packaging, the product looks and smells too similar to marijuana and may cause you issues when going through security at the airline or other transport company, or if you are pulled over while driving.

Instead, we suggest that you bring one or more of The Hemp Doctor’s tincture, softgel, balm, or edible products – pretty much anything but the hemp flower that could be confused with marijuana. Each of these products comes in a clearly labeled container that will serve to prove that the contents are, indeed, CBD or Delta 8 THC. Along those lines, be sure to keep your products in their original container when traveling to avoid suspicion.

Vape cartridges and pens may or may not cause you any issues. Carrying the original packaging with you may help, but an overly zealous security officer may question the substance within the vape. Also be sure that you understand and abide by any travel restrictions and vaping prohibitions for your mode of transportation, especially when it comes to airlines.

The Legality of CBD and Delta 8 THC

If you travel outside of your home state, you need to be concerned about the legality of your favorite hemp-based products. What is legal in one state may not be legal in another, even though federal law allows it.

CBD

Cannabidiol, or CBD for short, became legal in the United States on a federal level with the passing of The Farm Bill of 2018. This bill allowed for cannabis plants to be grown, processed into products, and sold as long as the plants and the final products adhered to four criteria:

  • The cannabis plant that the product is derived from must be the hemp strain of cannabis, not marijuana.
  • The plant and the final product may not contain more than .3% THC by weight.
  • The hemp must adhere to shared state and federal regulations.
  • A properly licensed farmer must grow the hemp.

This Farm Bill allowed for CBD to become federally legal across the US. However, some states have restrictions on the legality of CBD. For example, Nebraska and Idaho will only allow CBD products in their borders if the product contains 0% THC. Some states will allow for the CBD to be derived from marijuana, while other states strictly forbid it. The federal government has allowed states to determine their own rules when it comes to marijuana and marijuana-derived products. Before you travel, make sure you educate yourself on the laws of your destination and any states that you may be traveling through.

Delta 8 THC

Delta 8 THC is technically legal under The Farm Bill of 2018. This is because the bill specifies THC (tetrahydrocannabinol) as the Delta 9 THC cannabinoid. This is the renowned cannabinoid that is responsible for the high that users feel when they smoke marijuana. Even though technically legal on a federal level, there have been recent challenges to Delta 8 THC’s legality by some states and the DEA. As with CBD, we recommend educating yourself on the legality of Delta 8 THC for your destination.

Vaping Prohibitions

One other thing that you should be aware of when traveling is the wide variations between states when it comes to where vaping is allowed. Many states consider vaping in the same category as smoking. As such, many of these states don’t allow vaping in public buildings, private workplaces, restaurants, and bars. In contrast, some states have prohibitions for smoking but no such prohibitions when vaping. Again, it is important to educate yourself so that you know where you’ll be able to use your favorite vape once you reach your destination.
